Law "On the European Convention for the Protection of Human Rights and Fundamental Freedoms of 4 November 1950 and its Protocols No. 1, 2, 4, 7 and 11"
The European Convention for the Protection of Human Rights and Fundamental Freedoms of 4 November 1950 (hereinafter - the Convention) and its Protocols No. 1, 2, 4, 7 and 11 (hereinafter - the Protocols) are adopted and affirmed by this Law.
Requirements of Article 1 of Protocol No. 1 to the Convention will not be applied to the property reform regulating the restitution of the nationalized, confiscated, collectivized or otherwise illegally expropriated property or payment of compensation to former owners or their heirs, as well as to privatization of agricultural enterprises, collective fisheries and the state and local government property.
The Republic of Latvia recognizes in accordance with Article 25 of the Convention three years after depositing of the ratification letter the competence of the European Commission of Human Rights to receive claims addressed to the Secretary General of the European Council from any person, non-governmental organization or group of individuals declaring that they have suffered due to violations of rights mentioned in this Convention and its Protocols (including Articles 1-4 of the Protocol No. 4 and Articles 1-5 of the Protocol No. 7) committed by the Republic of Latvia.
The Republic of Latvia in accordance with Article 46 of the Convention three years after depositing of the ratification letter and on the basis of mutual agreement of the High Contracting Parties recognizes as mandatory ipso facto without special agreement about it the jurisdiction of the European Court of Human Rights regarding all issues related to interpretation and appliance of this Convention and its Protocol (including Articles 1-4 of the Protocol No. 4 and Articles 1-5 of the Protocol No. 7).
The Law takes effect as of the day of its promulgation. Simultaneously with the Law the Convention and the Protocols in English and their translation into Latvian shall be promulgated.
The Convention and the Protocols take effect in the time and procedure established in Paragraph 3 of Article 66 of the Convention and the Ministry of Foreign Affairs shall notify about it in the newspaper "Latvijas Vestnesis".
